Conservatorships and Guardianships
Guardianships
Legal proceedings in which a Court appoints a person (Guardian) to have the legal authority and duty to care for another person, especially because of the other’s infancy, incapacity, or disability.
Conservatorships
Legal proceedings in which a Court appoints a person to manage the estate or financial affairs of someone who is legally incapable of doing so, either by mental and/or physical incapacity.
Both Guardianships and Conservatorships are available remedies for minor children and adults. Mississippi law now allows for a limited guardianship and conservatorship, requiring minimal Court supervision, if the circumstances surrounding the need for the conservatorship are met.
